Your access to and use of this website is subject to the terms and conditions set out in this disclaimer, RequestSheet’s Privacy Policy, and any other notices, disclaimers, statements, and terms and conditions contained on this website (collectively, the “Terms and Conditions”). By accessing this website, creating an account, or accessing other websites through links provided by us, you agree to be bound by the Terms and Conditions. If you do not agree, do not use this website.

The information provided on this website is provided by RequestSheet in good faith and is believed to be accurate at the time of compilation. However, your use of this website is at your sole risk. Neither RequestSheet nor any related or affiliated entity of RequestSheet, nor any of their respective directors, officers, or employees (collectively, “RequestSheet Persons”), makes any representation or warranty as to the accuracy, reliability, timeliness, or completeness of the information contained in this website or in websites linked to this website. To the extent permitted by law, RequestSheet Persons disclaim all liability (whether arising in contract, tort, negligence, or otherwise) for any error or omission in the information on this website or in linked websites, or for any loss or damage (whether direct, indirect, consequential, or otherwise) suffered by any person.

RequestSheet may amend the Terms and Conditions at any time by posting an amended version on this web page. The “Last updated” date above reflects the most recent revision. Your continued use of this website after any amendment constitutes your agreement to be bound by the amended Terms and Conditions. RequestSheet has no obligation to notify you individually of such amendments, and it is your responsibility to review this page periodically.

Eligibility

To create an account or subscribe to a paid plan, you must be at least 18 years of age (or the age of majority in your jurisdiction) and capable of forming a binding contract. If you are using RequestSheet on behalf of a business or other entity, you represent that you have the authority to bind that entity to these Terms and Conditions.

Accounts and Security

If you elect to subscribe to RequestSheet’s services and subsequently access and use the RequestSheet web application (the “RequestSheet software”), you agree:

  • not to disclose to anyone the user ID and/or password required to access the RequestSheet software, to keep your credentials secure, and to inform RequestSheet immediately if your password is misused, lost, or stolen;
  • that you are responsible for all activity that occurs under your account;
  • that you have requested access to the RequestSheet software for your convenience and have made your own independent assessment of its suitability for your business, including the adequacy and security of the internet, and that you are satisfied therewith;
  • that RequestSheet will not be responsible for any errors in, or omissions from, the information submitted by you through the RequestSheet software, and RequestSheet has no liability for any loss arising in relation to such errors or omissions;
  • to indemnify RequestSheet Persons on an after-tax basis from and against all actions, claims, suits, demands, losses, liabilities, costs, and expenses (including legal fees and expenses) arising from or relating to your access to or use of the RequestSheet software, including, without limitation, any unauthorized access to your information and/or any RequestSheet Person acting or relying upon any information or instructions submitted by you via the RequestSheet software; and
  • that RequestSheet does not represent or warrant that the RequestSheet software will be error-free or available at all times, and you acknowledge the risks inherent in the use of the internet as a transmission medium. Accordingly, RequestSheet will not be liable for any loss arising from the use of the RequestSheet software as a means of submitting information, including but not limited to losses arising from: (i) any computer viruses, malicious code, or other technical defect (including loss, damage, or corruption of data); (ii) errors or delays during transmission or receipt of information and/or instructions; (iii) failure of transmission; (iv) misuse or fraudulent use or access by unauthorized persons; or (v) any circumstances beyond the reasonable control of RequestSheet, including, without limitation, the unavailability or interruption of the internet or other electronic communication services.

Trial Accounts

RequestSheet may offer free trial accounts at no cost to the user, the duration of which will be indicated at sign-up. RequestSheet is under no obligation to provide continued account access once the trial period has lapsed if the user has not upgraded to a paid subscription.

Paid Subscriptions and Payment

RequestSheet offers a range of subscription-based services with annual and month-to-month payment options. The cost of each service is listed on the relevant product page. By ordering a subscription, you agree:

  • that you are liable to pre-pay in full the amount indicated for the service(s) you require, whether an annual subscription, a month-to-month subscription, or any set-up fee;
  • that subscriptions are not automatically renewable, and you must renew manually for continued service once the period you have paid for has lapsed; and
  • that prices are subject to change, but any change will not affect a subscription period you have already paid for.

Payments are processed by third-party payment processors (including Stripe). Your use of those services is subject to the processor’s own terms and privacy policy. RequestSheet does not store your full payment card details; these are handled directly by the payment processor. RequestSheet is not responsible for the acts, omissions, or availability of any third-party payment processor.

Cancellation and Refunds

You may contact us regarding your account or subscription by emailing support@requestsheet.com. Upon receiving a cancellation request, your account will remain active for the period you have paid for, after which your account will be closed and your data permanently removed from our servers. RequestSheet does not provide refunds for unused services.

Acceptable Use

You agree not to use RequestSheet, and not to permit anyone using your account to:

  • submit, post, or transmit any content that is unlawful, defamatory, harassing, abusive, threatening, hateful, obscene, or otherwise objectionable;
  • infringe the intellectual property, privacy, or other rights of any person;
  • submit false, misleading, or fraudulent information, or impersonate any person or entity;
  • transmit spam, chain messages, or unsolicited communications, or harvest contact information for unauthorized purposes;
  • introduce viruses, malware, or other harmful code, or attempt to gain unauthorized access to the RequestSheet software, its servers, or any associated systems;
  • interfere with or disrupt the integrity or performance of the website, including by automated scraping, excessive request volume, or circumventing rate limits or security measures; or
  • use the website in violation of any applicable law or regulation.

RequestSheet reserves the right (but assumes no obligation) to monitor, review, and remove any content or to restrict any use that it determines, in its sole discretion, violates these Terms and Conditions.

User Content and Song Requests

RequestSheet enables disc jockeys (“DJs”) to receive song requests, messages, and similar submissions from members of the public (“Fan Content”), and enables DJs to create public profiles and post their own content (“DJ Content”). DJ Content and Fan Content are together referred to as “User Content.”

You retain ownership of the User Content you submit. By submitting User Content, you grant RequestSheet a non-exclusive, worldwide, royalty-free license to host, store, display, reproduce, and transmit that content for the purpose of operating and providing the website and its features (for example, displaying a song request on a DJ’s dashboard and public profile).

You are solely responsible for the User Content you submit and represent that you have all necessary rights to submit it and that it does not violate these Terms and Conditions or any applicable law. RequestSheet does not endorse, and is not responsible for, any User Content, and any reliance on User Content is at your own risk.

If you believe content on the website infringes your copyright or other rights, please contact support@requestsheet.com with sufficient detail to identify the content and your claim.

Tips and Bookings

The website may allow DJs to display links to third-party payment or “tip” services (such as PayPal, Venmo, or Cash App) and to receive booking inquiries from Fans. RequestSheet does not process, hold, or facilitate any tip payment, and is not a party to any booking, engagement, or transaction arranged between a DJ and a Fan. Any such payment or arrangement is solely between the parties involved, and RequestSheet is not responsible or liable for it.

Third-Party Information, Materials, and Websites

This website may provide information, articles, and material written and prepared by people who are not employees or representatives of RequestSheet. Such material is provided for your interest and convenience only and will be clearly identified as the product of an independent third party. RequestSheet is not responsible for the content or accuracy of this material, and the opinions expressed should not be taken as recommendations or opinions of RequestSheet.

This website may contain references or links to other websites or pages not operated by RequestSheet, and may display content (such as album artwork, track metadata, and previews) supplied by third-party services such as Apple Music / iTunes. Such links and content are provided for convenience and information purposes only. RequestSheet has not verified, and is not responsible for, the content of any third-party website or service, and does not endorse, approve, or recommend their operators or content. Following any link or otherwise interacting with a third-party website or service is entirely at your own risk, and RequestSheet shall not be responsible or liable for any loss, damage, or expense arising in connection with it.

To the maximum extent permitted by law, the website and the RequestSheet software are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. RequestSheet does not warrant that the website will be uninterrupted, timely, secure, or error-free, or that any defects will be corrected.

Limitation of Liability

To the maximum extent permitted by law, in no event will RequestSheet Persons be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunity, arising out of or relating to your use of (or inability to use) the website, even if advised of the possibility of such damages. To the maximum extent permitted by law, the total aggregate liability of RequestSheet Persons arising out of or relating to these Terms and Conditions or your use of the website will not exceed the amount you paid to RequestSheet for the service during the twelve (12) months immediately preceding the event giving rise to the claim.

Indemnification

You agree to indemnify, defend, and hold harmless RequestSheet Persons from and against all actions, claims, suits, demands, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from or relating to: (a) your use of the website or the RequestSheet software; (b) any User Content you submit; (c) your violation of these Terms and Conditions; or (d) your violation of any law or the rights of any third party.

Suspension and Termination

RequestSheet may, in its sole discretion and without notice, suspend, restrict, or terminate your access to the website or your account if it believes you have violated these Terms and Conditions, if required to do so by law, or to protect the website, its users, or RequestSheet Persons. Upon termination, your right to use the website ceases immediately. Sections of these Terms and Conditions that by their nature should survive termination (including those relating to intellectual property, disclaimers, limitation of liability, indemnification, and governing law) will survive.

Service Availability and Modifications

RequestSheet may, at any time and without notice, modify, suspend, or discontinue any feature or part of the website, in whole or in part. RequestSheet will not be liable to you or any third party for any modification, suspension, or discontinuance of the website or any feature.

Governing Law and Jurisdiction

These Terms and Conditions are governed by and construed in accordance with the laws of the State of Florida, United States of America, without regard to its conflict-of-law principles. You agree to submit to the non-exclusive jurisdiction of the state and federal courts located in Florida, and any courts that may hear appeals from those courts, in respect of any proceedings in connection with these Terms and Conditions or this website.

General

If any provision of these Terms and Conditions is found to be invalid or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force and effect. RequestSheet’s failure to enforce any right or provision will not be a waiver of that right or provision. These Terms and Conditions, together with the Privacy Policy, constitute the entire agreement between you and RequestSheet regarding the website and supersede any prior agreements. You may not assign or transfer these Terms and Conditions without RequestSheet’s prior written consent; RequestSheet may assign them without restriction. Nothing in these Terms and Conditions creates any agency, partnership, or joint venture between you and RequestSheet.
